A child arrangement order sets out who a child lives with and how much time they spend with each parent. It can be made by consent or following a contested hearing. Once in place it is legally binding and enforceable.
Where parents cannot agree, a lawyer will seek to negotiate a resolution first and, if that fails, make an application to the court.
If a child arrangement order is in place, you will generally need either the other parent’s consent or a court order. For international moves the bar is even higher still. The court will weigh the impact on the child’s relationship with the non-relocating parent, the reasons for the move, and whether meaningful contact can realistically be maintained. If the court believes the move will cause significant problems for the child, you can be refused.
Mediation uses a neutral third party to help parents reach agreement without litigation. It is faster and less adversarial in the right circumstances. It is not appropriate in every case. Where there has been domestic abuse, a significant power imbalance, or one party is acting in bad faith, court is often the only viable route. A good family lawyer will tell you honestly which path fits your situation.
