To marry legally in England and Wales, you must meet specific legal requirements. Many couples opt for religious ceremonies in addition to, or instead of, civil marriages. However, it’s important to ensure that the marriage ceremony is legally recognised in the country where it occurs. Otherwise, couples might mistakenly believe they are legally married when they are not.
For couples wishing to divorce, a civil divorce will legally end the marriage and give the parties the ability to make financial claims against each other, for example in respect of property, pensions or maintenance. However, the couple will remain married under their religious customs and will need to deal with this in their religious fora. The courts of England and Wales have no jurisdiction over religious marriages and divorces. There is an exception in relation to marriages abroad, where these marriages will legally be recognised in English law if they were carried out in accordance with the laws of the Country in which marriage was carried out.
