Whether someone pleaded guilty or was found guilty after trial there is a route to appeal the sentencing decision usually in situations where they can be shown to be wrong in law or wrong in principle or where it was simply excessive.

The regime for appealing a sentencing decision is different depending on whether the original decision was made in the Magistrates’ Court or Crown Court and there are different implications which may flow from the two separate procedures. Where the appeal is against the decision at the Magistrates’ Court, anyone is entitled to appeal and the sentence exercise will commence afresh at the Crown Court.

The Crown Court has the powers to reduce the sentence from the original however there is the possibility that they may pass a more onerous sentence than the original.  Where an appeal is unsuccessful costs may be awarded against the appellant.

Where an individual wishes to appeal a sentence passed at the Crown Court they must seek leave to appeal to the Court of Appeal. Where leave is granted the Court of Appeal will consider representations as to the appropriateness of the sentence and have the power to uphold the sentence or reduce the sentence as they see fit.
