Form B

What is a form B?

A Form B is used by respondents to request the family court to delay making a final order, which legally ends the marriage, until the parties finances are resolved. It is called a Notice of an application to consider the financial position of the Respondent after the divorce/dissolution.

Delaying the final order being made provides protection for the respondent as the court will not make a final divorce order unless satisfied that:

  • The applicant should not be required to make any financial provision for the respondent; or
  • The financial provision made by the applicant for the respondent is reasonable and fair or the best that can be made in the circumstances.
