When you separate from your partner, several practical matters arise, including determining who will be responsible for paying the daily living expenses once one of you leaves the family home.
The fact you are no longer living together does not release either spouse from the legal responsibilities that existed prior to the relationship breaking down, although what that responsibility looks like will depend on the fine print of your property ownership and your respective affordability.
If you find it difficult to manage all the expenses on your own, you might be able to negotiate a voluntary arrangement with your ex. Often, a simple conversation can resolve the issue. Mediation can also be an effective way to reach a mutually agreeable arrangement and prevent financial disputes while the divorce is being finalised.
If these options don’t work, you can seek assistance from the court. It is possible to apply to the court for your spouse to provide you with interim maintenance, also known as maintenance pending suit. Here the court will look at your short term income needs and will order your spouse to make payments to meet them. If such an application is required, your spouse might also be ordered to pay your legal costs relating to it.
The court will not permit your spouse to cut off you or your children. As experienced family lawyers, Vardags will help you negotiate interim solutions for your finances, and if necessary seek the court’s intervention to ensure that your needs are met.
