During financial proceedings, both parties are obligated to provide full and frank disclosure of their finances. Selling or hiding assets directly contradicts this obligation and carries serious legal consequences.
There may be legitimate reasons for selling assets, such as a mutual agreement to sell the family home. However, if you are worried that your spouse is selling assets at an undervalue, spending the proceeds, or transferring property to friends and family, you should seek urgent legal advice.
If you suspect that your spouse is selling assets to defeat or reduce your financial settlement claim, your solicitor can apply to the family court for an injunction order. An injunction can prevent your partner from disposing of property both in the UK and abroad. Essentially, the injunction ‘freezes’ the property to protect it, and the asset does not need to be in both of your names to be safeguarded. Alternatively, the court may reverse the sale or award you a greater share of the remaining assets.
