HOW CAN VARDAGS HELP WITH YOUR CHILD FINANCES MATTER?

The Child Maintenance Service (CMS) is the statutory body responsible for assessing and enforcing child maintenance. You can apply for child maintenance through the government’s website without needing to go through the courts, and the amount of maintenance due will be calculated based on both parties’ incomes and the time each parent spends caring for the children.

However, in circumstances where the CMS may not have jursidction or are not suitable in resolving matters fully, the Children’s Act 1989 gives the court power to make financial awards in respect of children.

Both married and unmarried parents can apply for financial provisions for their dependent children under Schedule 1 of the Children’s Act, covering housing, capital, and maintenance. For those who are separating and have children, you may be eligible to claim maintenance, school feels, capital and housing on behalf of your children.

If the court has jurisdiction to make an order, a judge can apply the following:

• Periodical payments paid weekly or monthly
• Lump sum payments
• Transfers of property
• Top up orders
