Leave to Remove

Leave to remove refers to the legal permission necessary to remove a child from the jurisdiction if the other person with parental responsibility does not consent to the childs relocation. To obtain leave to remove, a parent must make an application to the family court so that, if the parents cannot agree, the court will make a decision on their behalf.
