The Duchess of Sussex is suing the Mail on Sunday over a letter to her father Thomas Markle which the newspaper published in February last year. She alleges breach of copyright, breach of data regulation laws and a breach of her right to privacy.

The Mail on Sunday denied all three charges in a 44-page defence submitted to the High Court this week.

In an interview with Channel 5 News, Reputation and Privacy lawyer [Rory Lynch](https://vardags.com/team) suggested that Meghan has the stronger hand.

He explained that the initial legal test was whether Meghan had "a reasonable expectation that that letter should have been private", concluding that there was a strong argument that it was a "deeply personal letter" containing "private information".

The action is due to be heard in the Chancery division of the High Court. No hearing date has yet been set.

> "The test is, does Meghan have a reasonable expectation that that letter should have been private and I think you can argue that that was a deeply personal letter and that it is private information."
