Third-party disclosure order: Non-disclosure ============================================ What is a third-party or non-party disclosure order? ---------------------------------------------------- A third-party or non-party disclosure order is an order of the court which requires a non-party to the proceedings to provide documents and/or information about a certain subject. Generally, in family proceedings, it will be used to obtain financial information. If your spouse holds a large amount of wealth through trusts or corporate structures, such an order may be necessary. This will force the trustees or the company to provide you with evidence about what they are worth, for example, as well as the supporting documentation. Where a party refuses to disclose assets, it may be possible to get an order against financial institutions. This will require banks or other organisations to disclose what accounts they have with your spouse, and any other relevant information.
