Disclosing Financial Needs in Form E

What Is the Needs Section in Form E?

Section 3 of Form E focuses on your financial needs, both current and future. This includes your income needs (regular expenses) and capital needs (one-off or long-term costs). The goal is to help the court understand what financial support you require following divorce, including housing, living costs, and the needs of any children.

What to Include in the Needs Section

Part 1 – Income Needs

This section covers your regular expenses. You should detail:

  • Accommodation costs (rent, mortgage, council tax)
  • Household bills (utilities, internet, insurance)
  • Child-related costs (school fees, childcare, clubs, uniforms)
  • Personal expenses (food, clothing, travel, medical costs)
  • Pet care, subscriptions, and leisure activities

You should estimate these costs on a weekly, monthly, or annual basis, and include both current and anticipated future expenses.

Part 2 – Capital Needs

Capital needs refer to lump sum requirements for future stability. Common examples include:

  • Buying a new home (include estate agent listings to support your estimate)
  • Purchasing a car for commuting or childcare
  • Moving costs (stamp duty, legal fees, removal costs)
  • Furniture and appliances for a new residence

The court expects realistic and well-supported figures, so its helpful to research local property prices and include supporting documentation.

Why Is This Section Important?

The court uses this section to assess your standard of living during the marriage, your future financial needs, the needs of any dependent children, and whether a clean break is appropriate or ongoing support is required.

Being thorough and realistic helps the court make fair decisions and can strengthen your position in negotiations.
