Getting the best representation

Vardags is one of the UKs top divorce law firms. Ensuring that you have a lawyer that has both the specialist skills, knowledge and experience is something that you want to clarify in your initial questions with your solicitor. The areas you want to clarify are:

  • How experienced is the lawyer in family law, particularly divorce law? Have they dealt with cases that have similar circumstances that are relevant to your case?
  • How credible is the firm that the lawyer works for? Ask for further information in relation to how much experience the firm has in general in relation to divorce law.
  • What is the lawyers view on fair play? There is sometimes a misconception that there should be a winner and loser in a divorce- this is not the case and where the issues involve the ending of a personal relationship, often including children, you want to ensure that they understand the best approach in divorce cases.
  • How will they effectively ensure a good lawyer/client relationship especially when dealing with situations where emotions can be running high? Find out how frequently they will update you on your case and whether it will be one person with overall control and as a contact point.

Practical Questions

There will be many practical questions that you will have at the start of the divorce process and again a top divorce lawyer will understand this and be able to assist:

Issues relating to finances

  • A major concern is often what will happen to the family home and whether it will have to be sold. There may also be queries about whether you can change the locks on the home if the other spouse moves out.
  • Discuss whether in your circumstances it would be better to think about a clean break arrangement or if spousal maintenance is more appropriate.
  • Ask for the lawyers opinion on how child maintenance arrangements are likely to be agreed.
  • The costs and payment schedule of the divorce itself should be detailed at this first meeting, including whether it is appropriate for your spouse to pay your costs.
  • Ask for advice on your bank accounts, particularly where you have accounts in joint names.

Issues relating to children

  • What are the options for the children following divorce?
  • Where will the children live?
  • Will both parents have contact?
  • Can you still take your children on holiday abroad during/following divorce?

Legal issues

  • What will be the process for the divorce? This can be affected by various issues, such as whether your spouse will agree to sign the divorce papers. It may also be relevant where the wedding happened abroad.
  • Are you eligible to get a divorce and under which of the five grounds?
  • What can you do if your spouse objects to the divorce or the grounds?
  • How long will the divorce take approximately based on the facts given?
  • Will you have to go to court? Is it necessary to use mediation?
  • Can you still talk to your spouse during the proceedings?
  • Should you change your Will?
